1. LIMITED WARRANTY
Apex Floor Coating (“Apex”) warrants that the residential garage floor coating system installed at the property identified above will be free from covered installation defects, subject to the terms, conditions, limitations, and exclusions outlined in this warranty.
This warranty applies exclusively to the original purchaser and original installation address, from the original installation date. It is nontransferable and is not a guarantee against normal wear, damage, or deterioration.
The warranty consists of the following coverage:
- Lifetime Hot Tire Pickup Warranty: Limited lifetime coverage against hot tire pickup, as specifically defined in Section 2.
- Limited Workmanship Warranty: One (1) year from the date of installation, covering qualifying installation defects as defined in Section 3.
No other warranties, express or implied, are provided beyond those expressly stated herein, to the extent permitted by applicable law.
2. LIFETIME HOT TIRE PICKUP WARRANTY
Apex provides a limited lifetime warranty exclusively against hot tire pickup of the installed coating system.
Definition of Hot Tire Pickup:
Hot tire pickup occurs when vehicle tires, heated during normal driving, cause the coating to soften or adhere to the tire and subsequently separate from the concrete surface when the vehicle is moved.
Coverage:
If the coating experiences verified hot tire pickup under normal residential garage use during the original purchaser’s lifetime of ownership of the property, Apex will, at its sole discretion:
- Repair the affected area; or
- Replace the affected coating in the affected area.
The remedy will be limited to the affected area and will not include replacement or recoating of the entire garage floor unless Apex determines it is necessary.
Conditions of Lifetime Coverage:
- The coating must have been installed by Apex.
- The property must remain owned by the original purchaser.
- The floor must be used for ordinary residential garage purposes.
- The coating must have been maintained in accordance with Apex’s care instructions.
- The failure must be directly attributable to hot tire pickup and not another excluded cause.
- The customer must provide reasonable access for inspection and repair.
Lifetime Coverage Limitations:
Lifetime coverage does not include:
- General coating wear, fading, discoloration, or loss of gloss.
- Scratches, gouges, chips, impact damage, or abrasion.
- Damage caused by vehicle fluids, chemicals, solvents, or corrosive materials.
- Coating failure resulting from concrete cracking, movement, moisture, or structural defects.
- Damage caused by improper cleaning, maintenance, or use.
- Damage caused by snowplows, floor jacks, jack stands, heavy equipment, or other concentrated loads.
- Damage caused by vehicle tires that have been exposed to chemicals, solvents, or other unusual contaminants.
- Damage resulting from modifications, repairs, or coatings applied by others.
The lifetime warranty applies only to hot tire pickup. It does not constitute a lifetime warranty on the coating’s appearance, performance, adhesion against all forms of failure, or overall service life.
3. LIMITED WORKMANSHIP WARRANTY — ONE YEAR
Apex warrants its installation workmanship for a period of one (1) year from the original installation date.
During this period, Apex will repair areas where the coating has demonstrably failed due to defective installation performed by Apex.
Covered workmanship defects are limited to:
- Improper adhesion of the coating directly attributable to Apex’s installation procedures.
- Delamination caused by an installation error, excluding failures caused by moisture, concrete defects, contamination, or other excluded conditions.
- Installation-related defects that materially compromise the coating system’s intended function.
Apex reserves the right to inspect and determine the cause of any alleged defect before approving warranty service.
The one-year workmanship warranty does not cover cosmetic imperfections, normal wear, minor surface irregularities, or defects resulting from conditions outside Apex’s control.
After the one-year workmanship warranty expires, all workmanship-related claims are excluded, except for qualifying hot tire pickup claims covered under Section 2.
